A. General Information

1. Marketing zwischen Theorie und Praxis e.V.

1.1 MTP – Marketing zwischen Theorie und Praxis e.V. (hereinafter referred to as "MTP") is a non-profit association with the aim of promoting marketing education. This is done through professional training as well as other events that aim to enable the transfer of knowledge between theory and practice. The events are organized by MTP and pursue this goal or any other goal with regard to membership recruitment.

2. Special features of the event

2.1 MTP cooperates with external service providers, among others, in the implementation of the event. Therefore, for each event, the special conditions of the respective external service providers, in particular deadlines, must be reflected in the "Supplementary Event Conditions" of the respective event.

3. Scope of application

3.1 The basis of the cooperation between MTP and the event participants are the following General Terms and Conditions for Events, with which the event participant agrees upon registering for an event. These apply to all services provided by MTP, unless explicitly agreed otherwise in writing. Deviating agreements with the event participant are only valid if they have been confirmed in writing by MTP. Previous general terms and conditions of MTP for the event hereby lose their validity. The basis of all contracts is the service description made in our offers, whereby minor deviations are possible, as well as the "Supplementary Event Conditions" of the respective event. The participation requirements stated in the offers apply. The order processing is carried out with the help of an electronic data processing system. Necessary data will be stored. MTP undertakes to comply with the provisions of the Data Protection Act and to treat information - of whatever kind - about the participant and / or the business and company internals of the event participant confidentially.

B. GENERAL CONDITIONS FOR THE EVENT

1. Conclusion of contract

1.1 The regulations for the registration of the event participant for the event are described in the respective "Supplementary Event Terms and Conditions". In good time before the start of the event, the event participant will receive an invitation with all the necessary information such as the venue, start and end of the event, directions, and hotel suggestions.

1.2 By concluding the contract, the event participant acknowledges the General Terms and Conditions and the "Supplementary Event Terms and Conditions". In addition to the General Terms and Conditions of MTP, the participant also expressly accepts the General Terms and Conditions and other regulations of the external service providers with regard to safety-related regulations, liability exclusions based on the special nature of the offer, as well as house and usage regulations, so that these become part of the contract between the event participant and MTP.

2. Cancellation of participation in the event by the event participant

2.1 The cancellation declaration of the event participant must be made in writing (letter, e-mail). The deadlines for cancellation before the start of the event as well as the respective cancellation fees are bindingly regulated in the "Supplementary Event Terms and Conditions". With the registration these regulations are expressly recognized. In case of non-attendance, the full participation fee (100%) will be charged.

2.2 The date of receipt of the message by MTP shall be decisive for meeting the deadline.

2.3 The event participant shall be given the option to send a substitute participant to the event without incurring additional fees, unless the customer has booked at a price that is then no longer valid (early booking discount). In this case, the then valid price must be paid. However, the substitute participant must meet the participation requirements.

2.4 The event participant shall be given the opportunity to prove that MTP has not incurred any damage as a result of the cancellation or that the damage is significantly lower than the cancellation fee. In this case, the proven damage will be invoiced.

3. Cancellation by the MTP

3.1 In case of insufficient number of participants, insufficient financing of the event and in cases of force majeure, MTP reserves the right to cancel the event. The minimum number of participants is stated in the "Supplementary Event Conditions". In case of insufficient number of participants and insufficient financing of the event, the event participant will be notified at the latest by the deadline specified in the "Supplementary Event Terms and Conditions" before the start of the event, in cases of force majeure as soon as possible. Payments already made will be refunded as soon as possible.

3.2 Force majeure within the meaning of this provision includes, but is not limited to, labor disputes, breaches of contract by external service providers, subcontractors and vicarious agents, illness, accident, earthquake, fire, flooding, acts of war, embargo, riots and other circumstances beyond the reasonable control of MTP that prevent it from fulfilling its contractual obligations.

3.3 Claims by the event participant for damages or reimbursement of expenses incurred or further claims by the event participant are excluded in principle, unless MTP or its vicarious agents are guilty of intent or gross negligence or there is mandatory liability by law due to the absence of a warranted characteristic or an obligation that is decisive for the achievement of the overall purpose of the contract.

4. Prices, services, terms of payment

4.1 MTP shall provide the services expressly mentioned in the event description. Minor deviations such as the replacement of a workshop with an equivalent one or the relocation of an event to another location in the same regional area are possible. The event participant has no right to services that are not expressly listed in the event description, in particular not for arrival and departure as well as accommodation.

4.2 Unless otherwise agreed in writing between MTP and the event participant, the event fee is due immediately after registration. For events with participation fees staggered according to the time of registration, the participation fees are due no later than the last day of the period in which the reduced participation fee is offered. Thereafter, the participation fee valid at that time will be due. The date of receipt of payment is decisive for the participation fee to be charged in each case.

4.3 If the event participant does not pay the participation fee due by the start of the event, MTP is entitled to exclude him or the respective substitute participant from the event. The participation fee shall nevertheless be paid in full (100%) to MTP.

5 Warranty and liability

5.1 If any deficiencies in the service provided by MTP are due to the fact that the event participant has not fulfilled, has not fulfilled completely and/or has not fulfilled in time any obligations to cooperate in accordance with the event description, liability on the part of MTP is excluded.

5.2 MTP shall only be liable for damages to the event participant insofar as MTP is guilty of intent or gross negligence or insofar as liability is mandatory by law or according to case law due to the absence of a warranted characteristic or an obligation that is decisive for the achievement of the overall purpose of the contract. This shall also apply to any liability for culpa in contrahendo, faulty advice or instruction, or for breach of ancillary contractual obligations, or for liability in tort.

5.3 The liability of MTP in commercial transactions shall in any case be limited to the damage typically occurring in legal transactions of the present type.

5.4 The beginning and end of the limitation period as well as the limitation period shall be governed by the statutory provisions.

6. photo and film shooting

6.1 Throughout the event, photographs and film footage will be taken, reproduced and used by the organizer and / or by corporate or media partners. The scope of use is focused on the current reporting and documentation in print media and / or Internet (e.g. homepage, Facebook, Instagram) whereby the photo and video recordings are distributed, as well as the live stream of the event itself. With the registration, each participant of the event agrees that these recordings also depict the person of the enrollee and may be used for the aforementioned purposes for an unlimited period of time and without compensation.

7. Closing provisions

7.1 The parties agree that ancillary agreements, amendments to the contract and changes to the contract shall be made in writing. Digital correspondence shall be sufficient in this respect.

7.2 The contractual relationship between MTP and the event participant shall be governed by the laws of the Federal Republic of Germany.

7.3 The place of jurisdiction for all disputes arising in connection with this contract is Frankfurt am Main. However, MTP is entitled to choose the court responsible for the event participant's place of residence.

7.4 If individual provisions of this contract are or become invalid in whole or in part, or if they cannot be implemented, this shall not affect the validity of the remainder of the contract. In this case, the parties agree to replace the invalid or unenforceable provision by a valid provision which realizes the economic purpose pursued by it as far as possible.
